RISE Membership Liability Waiver & Release Agreement

 

This Liability Waiver and Release Agreement (the "Agreement") is entered into by and between the undersigned participant ("Participant") and The Holistic Psych NP Company, its affiliates, officers, directors, employees, independent contractors, and any licensed professionals participating in RISE Membership, including but not limited to Nurse Practitioners, Registered Dietitians, Yoga Instructors, and other licensed professionals (collectively referred to as "Released Parties").

 

  1. Acknowledgment of Risk

 

The Participant acknowledges and understands that participation in RISE Membership activities, including but not limited to educational sessions, wellness programs, yoga, nutritional guidance, and holistic health consultations, involves inherent risks, including but not limited to physical injury, mental or emotional distress, and unforeseen complications. The Participant voluntarily assumes all risks associated with these activities and understands that participation is entirely voluntary.

 

  1. Release and Waiver of Liability

 

To the fullest extent permitted by law, the Participant hereby releases, waives, and discharges the Released Parties from any and all liability, claims, demands, actions, or causes of action, arising out of or related to any loss, damage, injury, or harm of any kind, including but not limited to bodily injury, illness, or economic loss that may result from participation in RISE Membership activities. The Participant agrees that they are solely responsible for their own safety and well-being during participation.

 

  1. No Medical Advice or Treatment Guarantee

 

The Participant acknowledges that the services provided through RISE Membership, including consultations and educational content, are for informational and wellness purposes only. These services do not constitute medical diagnosis, treatment, or therapy. The Participant agrees that no professional within the RISE Membership program, including Nurse Practitioners, Registered Dietitians, and Yoga Instructors, is liable for any outcomes resulting from decisions the Participant makes based on the provided information. The Participant understands that they should consult with their own healthcare provider before making any health-related decisions.

 

  1. Indemnification

 

The Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, expenses, and costs (including reasonable attorneys’ fees) arising out of or related to participation in RISE Membership. This includes, but is not limited to, injuries sustained, adverse health effects, or any other consequences resulting from participation.

 

  1. Assumption of Responsibility

 

The Participant agrees that they are solely responsible for their own health, actions, and decisions. They acknowledge that they have the option to seek professional medical advice from their healthcare provider before participating in any activities or applying any information from the RISE Membership program. The Participant assumes full responsibility for any personal choices made based on the information received.

 

  1. Confidentiality & Non-Disclosure

 

The Participant understands that RISE Membership may involve discussions of personal health and wellness topics. The Participant agrees to respect the confidentiality of all members and not to disclose or share any personal information obtained through RISE Membership without explicit permission. The Holistic Psych NP Company reserves the right to remove any Participant who violates confidentiality standards.

 

  1. Governing Law & Dispute Resolution

 

This Agreement shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to conflict of law principles. Any disputes arising from this Agreement shall be resolved through mediation. If mediation is unsuccessful, disputes shall be settled in a court of competent jurisdiction in Arkansas.

 

  1. Acknowledgment and Signature

 

By signing below, the Participant acknowledges that they have read and understood this Agreement, and voluntarily agree to its terms. The Participant affirms that they are at least 18 years of age and legally competent to sign this Agreement. If signing on behalf of a minor, the undersigned affirms they are the legal guardian and accept full responsibility for the minor’s participation.
